Terms of Service

Welcome to Cued Up. These Terms of Service ("Terms") govern your use of the Cued Up platform operated by Cued Up LLC ("we," "us," or "our"), a New Jersey limited liability company. By creating an account or using our services at cuedupapp.com, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use our platform.

1. Acceptance of Terms

By accessing or using Cued Up, you confirm that you are at least 13 years old and have the legal capacity to enter into these Terms. If you are using the platform on behalf of a business (e.g., as a venue owner), you represent that you have the authority to bind that business to these Terms.

2. Age Requirement

You must be at least 13 years old to use Cued Up. By creating an account, you represent that you are at least 13 years old. If we learn that an account holder is under 13, we will terminate the account and delete all associated data immediately.

3. Account Responsibilities

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to:

  • Provide accurate and complete information when creating your account
  • Keep your login credentials confidential
  • Notify us immediately if you suspect unauthorized access to your account
  • Not create multiple accounts for the purpose of abusing platform features, manipulating rankings, or evading bans

4. Subscription Billing

Cued Up offers both free and paid subscription plans for players and venues. By subscribing to a paid plan:

  • Auto-Renewal: Subscriptions automatically renew at the end of each billing period (monthly) unless you cancel before the renewal date.
  • Payment: All payments are processed securely through Stripe. You authorize us to charge your payment method on file for recurring subscription fees.
  • Price Changes: We may change subscription prices with at least 30 days' notice. Price changes take effect at your next renewal date.
  • Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period — you will retain access to paid features until then.
  • Refunds: Subscription fees are generally non-refundable. If you believe you were charged in error, contact us within 14 days at kyle@cuedupapp.com.

Player Plans

  • Free ($0): Full gameplay — game tracking, ELO ratings, leagues, tournaments, challenges, venue discovery, practice drills, and community features. Includes ads.
  • Verified ($14.99 one-time): Everything in Free plus ad-free experience, verified badge on your profile, and 10% bonus on credit purchases.
  • Pro ($9.99/month): Everything in Verified plus deep analytics, session recaps, form charts, daily challenges, custom profile customization, match history export, and early access to new features.

Venue Plans

  • Venue ($49.99/month): One flat plan with every feature included — unlimited tables and staff accounts, game tracking, QR check-ins, kiosk mode, TV displays, tournaments, leagues, events, specials, drink deals, venue chat, and full analytics.
  • Enterprise: Custom pricing for operators managing tables across multiple locations.

5. Credits

Cued Up may offer optional virtual credits ("Credits") that can be purchased or earned on the platform. Credits are entertainment-only virtual currency and cannot be redeemed for cash or any real-world monetary value. Credits are redeemable solely in-person at participating venues for services and goods provided by those venues. Regarding Credits:

  • Credits are entertainment-only virtual currency with no cash value and cannot be redeemed for real money under any circumstances
  • Credits are non-refundable and non-transferable except as permitted within platform features
  • Credits are not used to purchase digital content, features, or functionality within the Cued Up app. Tournament entry fees, when any, are collected by the hosting venue in person at the event — not through the app
  • We reserve the right to modify the Credit system, including pricing and redemption options, at any time
  • Unused Credits do not expire as long as your account remains active. If your account is terminated for any reason, all remaining Credits are forfeited and have no cash value

6. Tournaments

Cued Up supports skill-based pool tournaments organized and hosted by venues. Tournament entry fees are for participation in skill-based contests. Cued Up does not take a cut of tournament prize pools; entry fees are distributed to winners and the hosting venue per the venue's declared payout structure. Tournaments on this platform are contests of skill, not games of chance.

7. User Content

You may submit content to the platform, including posts, chat messages, direct messages, comments, profile information, highlight clips, and marketplace listings ("User Content"). Regarding User Content:

  • Ownership: You retain ownership of the content you create.
  • License: By posting content, you grant Cued Up a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content in connection with operating and promoting the platform.
  • Responsibility: You are solely responsible for the content you post. Do not post content that is illegal, harassing, defamatory, or infringes on the rights of others.
  • Moderation: We reserve the right to remove any content that violates these Terms or that we deem inappropriate, without prior notice.

Zero Tolerance for Objectionable Content and Abusive Users

Cued Up enforces a zero-tolerance policy for objectionable content and abusive behavior. The following are strictly prohibited and will result in content removal and, where appropriate, immediate account termination:

  • Sexually explicit, pornographic, or sexually suggestive content involving any person
  • Content depicting or promoting violence, self-harm, or threats against any person or group
  • Harassment, hate speech, bullying, intimidation, or targeted abuse of any user
  • Content that exploits, endangers, or sexualizes minors in any way
  • Doxxing, sharing private information without consent, or revenge content
  • Content promoting illegal activity, including drug sales, illegal gambling, or weapons trafficking
  • Spam, scams, phishing, fraudulent listings, or impersonation of other persons or organizations
  • Content infringing on intellectual property rights of others

How to Report Objectionable Content or Abuse

Every post, chat message, direct message, profile, marketplace listing, and highlight clip in the Cued Up app and on this website has a built-in "Report" option. Tap the "…" menu next to any User Content and choose "Report" to flag it for review.

You may also report content or behavior by emailing kyle@cuedupapp.com with the URL or screenshot of the content, the username of the person involved, and a description of the issue.

We commit to reviewing every reported piece of content or user behavior within 24 hours of receipt. Confirmed violations result in content removal and, depending on severity, may result in temporary suspension or permanent termination of the offending account.

How to Block Abusive Users

Every user profile in Cued Up has a "Block" option. When you block another user:

  • You will no longer see any content posted by that user (community posts, comments, highlights, marketplace listings)
  • That user will not be able to send you direct messages, friend requests, or challenge invitations
  • That user will not be able to see your profile, posts, or activity
  • You can unblock a user at any time from your account settings

Blocking is independent from reporting. Use block to protect your own experience; use report to flag violations for our review and platform-wide action.

Content Filtering and Pre-Moderation

Cued Up applies automated content filtering to chat messages, direct messages, community posts, marketplace listings, and profile fields. Filters detect and block known patterns of objectionable language, threats, and spam at the time of submission. Filters are imperfect; content that bypasses automated filtering is subject to user report + human review as described above.

8. Prohibited Conduct

You agree not to:

  • Use the platform for any unlawful purpose
  • Harass, bully, or threaten other users
  • Manipulate rankings, stats, or game outcomes through dishonest means
  • Create fake accounts or impersonate other users
  • Attempt to gain unauthorized access to other accounts or our systems
  • Use bots, scrapers, or automated tools to access the platform without permission
  • Interfere with or disrupt the platform or its infrastructure
  • Circumvent any security measures, rate limits, or access restrictions
  • Use the platform to spam, advertise, or solicit without authorization

9. Venue Owner Responsibilities

If you register as a venue owner or manager, you agree to the following additional responsibilities:

  • You must have legal authority to represent the venue you register
  • Venue information (name, address, hours, table count) must be accurate and kept up to date
  • You are responsible for managing your staff accounts and their access permissions
  • You must comply with all applicable local, state, and federal laws in operating your venue
  • You may not use the platform to collect or misuse player data beyond what is necessary for venue operations
  • Venue creation is subject to approval — not all requests will be granted

10. Intellectual Property

The Cued Up name, logo, branding, software, and all associated content (excluding User Content) are the intellectual property of Cued Up LLC. You may not copy, modify, distribute, or create derivative works from our intellectual property without our written permission.

"APA" and "BCA" are trademarks of their respective organizations. Cued Up is not affiliated with, endorsed by, or officially connected to the American Poolplayers Association or the Billiard Congress of America.

11. Disclaimers

Cued Up is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the platform will be uninterrupted, error-free, or secure at all times.

We are not responsible for the accuracy of user-submitted content, venue information, or game results. We do not verify the identity of users or the legitimacy of venues beyond our standard approval process.

12. Limitation of Liability

To the maximum extent permitted by law, Cued Up LLC and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to loss of data, loss of profits, or loss of Credits.

Our total liability for any claim arising from these Terms or your use of the platform shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100, whichever is greater.

13. DMCA Copyright Policy

Cued Up respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA). If you believe that content on the platform infringes your copyright, you may submit a takedown notice to our designated DMCA agent.

A valid DMCA notice must include:

  • A physical or electronic signature of the copyright owner (or authorized agent)
  • Identification of the copyrighted work claimed to be infringed
  • Identification of the infringing material and where it appears on Cued Up (e.g., URL, screen, username)
  • Your contact information (name, address, phone, email)
  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the owner

Send notices to our DMCA agent at kyle@cuedupapp.com with the subject line "DMCA Takedown." We will respond promptly. Repeat infringers will have their accounts terminated.

If you believe content was removed in error, you may submit a counter-notice with the same elements above plus a statement consenting to the jurisdiction of the federal court in the district of your address (or, if outside the US, in New Jersey).

14. Dispute Resolution & Arbitration

Informal Resolution

Before filing any formal claim, you agree to first contact us at kyle@cuedupapp.com and attempt in good faith to resolve the dispute informally within 30 days.

Binding Arbitration

If we cannot resolve the dispute informally, you and Cued Up LLC agree that any claim, dispute, or controversy arising out of or relating to these Terms or your use of the platform will be resolved exclusively by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, or by JAMS under its Streamlined Arbitration Rules if AAA is unavailable. The arbitration will be conducted in English, in the State of New Jersey or remotely, with a single arbitrator. Judgment on the award may be entered in any court of competent jurisdiction.

Class Action Waiver

You and Cued Up agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate claims of more than one person without consent of all affected parties and may not preside over any form of representative or class proceeding.

30-Day Opt-Out

You may opt out of this arbitration agreement by emailing kyle@cuedupapp.com with the subject line "Arbitration Opt-Out" and your account email within 30 days of first agreeing to these Terms. Opting out will not affect any other part of these Terms.

Exceptions

Either party may bring an individual action in small-claims court for disputes within that court's jurisdiction. Either party may also seek injunctive or equitable relief in court to protect intellectual property rights.

Governing Law & Venue

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. For any claim not subject to arbitration, you and Cued Up consent to the exclusive jurisdiction of the state and federal courts located in New Jersey.

15. Cancellation & Termination

Cancellation

You can cancel your subscription at any time through your account settings. You will retain access to your paid features until the end of your current billing period. After that, your account reverts to the Free plan. Your data is preserved.

Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in prohibited conduct, or that we reasonably believe pose a risk to the platform or other users. Upon termination, your right to use the platform ceases immediately. Any Credits in your account at the time of termination due to a Terms violation are forfeited.

You may also request permanent deletion of your account and all associated data by contacting kyle@cuedupapp.com.

If you withdraw consent to data processing, we may not be able to provide certain features. You can request account deletion, which will permanently remove all your data.

Sections that by their nature should survive termination (including Limitation of Liability, Dispute Resolution, and Intellectual Property) will continue to apply.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Effective Date" at the top of this page and notify you through the platform or by email. Your continued use of Cued Up after changes are posted constitutes your acceptance of the updated Terms.

If you disagree with any changes, you may close your account before the changes take effect.
